Thank you all for strong advise and power bosting responses: Here are some fact:
My employer is Desi. If you already did not know of this and to make the matter worst Lawyer is Desi too. So there is absolutely no help from either side.
1) Can I request the Receipt Number from INS instead. Will they give me the receipt number if I go in person and provide all the validation.
2) I am current. I am under EB2 , Other country than India and China ( no not Pak either) and I can file 485. My problem is now doubled as I have been married for 2 years and my wife is home all day doing nothing.
My desperation is only to get EAD and make her work. I have tried all thing possible with my current Employer but of no help. If I leave his company than I have to start from ZERO which is good 8-9 months even if I start the process now. This is all my worries.

I have the same problem the Company Is Accurate Diagnostic Lab, Edison NJ.
He hasn't give my last pay check and i still haven;t received the W-2 Form. For the paycheck i already complain in Labor. since last 2 month still haven't got anything. Let see what happens about my W-2.
I think you should share your company experience at this website and will help other too and stay away from these useless companies..

check with your consulate or take it from someone who did the same in the respective consulate. sometimes procedure done in sfo will be a bit different than what would be expected in yew-york. iam not sure why though.

Do we need EAD in hand to invoke AC21?
1) Applied I-485 and AP, did not apply for EAD.
2) After 180 days, can you move to a new company without EAD in hand? I mean H1-B transfer and moving I-485 to new company?
You can either transfer H1B or use EAD. In any case, you are invoking AC21 to keep your I-485 alive.

When they start processing the 485 AOS,they allot visa number.
If it retrogressed but visa number had alreday been alotted to her case,approval is possible,otherwise June 2005 approval is not possible.
If it happened,it means august bulletin might have June 2005 as cutoff date(they secretly changed the July VB and changed it back to "U" from "C"

It could be the answer to our question why they are holding July filing cases and why they stopped adjudicating 485 cases for which they pull out the numbers before July 2, 2007. What a mess!

Hi to all,
Is there any one to help me.My question is iam on h4 visa status.I wana apply h1 under 2007 quota.But the problem is my husband's H1 is going to be expired this september 21st.Our emloyer applies new visa before one month of expiry.If i apply for h1 is it creates any problem.I would appreciate if any body helps.

Ask your husband's employer to apply for H1 & H4 little sooner. You can actually apply 6 months before expiry. This way you can get your H4 before your H1 gets processed. You want to make sure that your H1 gets approved after your H4.

The PD is yours to keep even if the original company revokes the approved I-140. The risk of loosing PD is only when the approved I-140 is revoked by USCIS itself due to fraud in the application.

Long shot - any idea how many EB3 are pending (I458s + I140s waiting for PD to be current)?. Just trying to estimate with current rate of 3k EB3 per year, how long it will take to clear the backlog untill PD March 2010 :)
No of Eb3 pending till Jan 2010 = 60,050
Total Wait time = 60,050 / 2,987 (annual quota for India Eb3) = 20 years (approx)
However a lot of ppl will lose jobs and their green card process doomed, move from eb3 to eb2, some will abandon their gc dream and go back to india. So 7-8 years would be the realistic timeline.

You need to wait at least 180 days after I-485 receipt date, then you can port your I-140. You are not required to do anything to use AC21 (notifying the USCIS is not necessary), but you have to make sure the new job has the same or similar occupational code (SOC) (you can find it in LC). I ported twice with no issues, no RFE and received my GC.

I guess you meant the receipt date (when USCIS received the package). That would be my first instinct too, at least going by the common sense. Which is why I am a bit confused with that fellow's comment (in the link in my post that you quoted).
I meant the date I mailed my 765 application (not the USCIS receipt date). We had sent our app on June 29th and my receipt date is august 24th. I am going to write June 29th (not august 24th) since that's the date I had applied for my EAD. Doesn't that make sense?
